Terms of Service

1. Agreement to terms

By accessing or using Koda (the "Service"), you agree to be bound by these Terms of Service (the "Terms"). If you are using the Service on behalf of a company or organization, you represent that you have authority to bind that entity and that it accepts these Terms.

Our Privacy Policy describes how we collect and use information when you use the Service, including product analytics we perform with PostHog (usage measurement, in-product events, and—when you are logged in—association with your account as described there). By using the Service, you acknowledge those data practices.

2. Eligibility & accounts

You must be at least 18 years old and legally able to enter into contracts to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3. Use of the service

Koda helps you generate and manage user interface designs and code. You are solely responsible for how you use any designs, mockups, or code produced by the Service, including reviewing, testing, and adapting it before using it in production.

You agree not to:

  • Use the Service in violation of any applicable law or regulation.
  • Reverse engineer or attempt to derive the source code of any non-open components of the Service.
  • Interfere with or disrupt the integrity or performance of the Service.

4. Your content

You may upload prompts, assets, URLs, screenshots, and other content into the Service ("Your Content"). You retain all rights to Your Content. You grant Koda a worldwide, non‑exclusive license to use, reproduce, and process Your Content solely for the purpose of providing and improving the Service.

5. Intellectual property

Koda and its licensors retain all rights, title, and interest in and to the Service, including but not limited to the software, documentation, branding, and underlying models. Except for the limited rights expressly granted in these Terms, no other rights are granted, whether by implication or otherwise.

6. Paid plans & billing

If you purchase a paid plan, you authorize Koda and its payment processor to charge your chosen payment method for the applicable fees, taxes, and any renewal amounts. Unless stated otherwise, subscriptions renew automatically until cancelled. You may cancel at any time, but fees are non‑refundable except where required by law.

7. Disclaimer of warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory. Koda specifically disclaims any implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.

8. Limitation of liability

To the maximum extent permitted by law, Koda will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the Service.

9. Termination

We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms or are using the Service in a way that could create legal exposure for us or harm other users. You may stop using the Service at any time.

10. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will provide notice (for example, by updating the "Last updated" date, posting a notice in the product, or sending an email). Your continued use of the Service after the changes become effective constitutes your acceptance of the updated Terms.
